1. Agreement to Terms
These Terms of Use ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Helix Data Solutions Limited ("Company," "we," "us," or "our"), a company registered in New Zealand, regarding your use of the JABBA mobile application ("App" or "Service").
By downloading, installing, or using JABBA, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
Important: JABBA is a budgeting and financial tracking tool. It does not provide financial advice. Always consult a qualified financial professional for important financial decisions.
2. Description of Service
JABBA ("Just Another Budgeting App") is a personal finance management application that helps you:
- Track Commitments: Monitor recurring bills, subscriptions, loans, and other financial obligations
- Import Transactions: Import bank statement CSV files to track your spending
- Calculate True Balance: See your actual available balance after accounting for upcoming commitments
- AI-Powered Features: Receive intelligent repayment strategy recommendations and automatic CSV field detection
- Multi-Device Sync: Optionally synchronize your data across multiple devices
- Expected Payments: Track and match expected income and payments
The App is designed for personal, non-commercial use to assist with individual or household financial management.
3. Account Registration
3.1 Account Creation
To access certain features of JABBA, you must create an account by providing a valid email address. We use email-based authentication - you will receive a verification code each time you sign in.
3.2 Account Security
You are responsible for:
- Maintaining the security of your email account
- All activities that occur under your JABBA account
- Notifying us immediately of any unauthorized access
3.3 Account Information
You agree to provide accurate and complete information when creating your account and to update this information as needed.
4. Subscription Terms
4.1 Free Trial
New users receive a 75-day free trial with full access to all features. The trial begins automatically when you first open the App. No payment information is required to start your trial.
After the first 30 days, you will see a countdown indicating the remaining days in your trial period.
4.2 Subscription Options
After your trial ends, you may subscribe to continue using premium features:
- Monthly Subscription: $4.99 USD per month
- Annual Subscription: $49.99 USD per year (equivalent to 2 months free)
Prices may vary by region and are displayed in your local currency in the App Store.
4.3 Billing
- All payments are processed through Apple's App Store
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
- Your Apple ID account will be charged upon confirmation of purchase
- You can manage and cancel your subscription in your App Store account settings
4.4 Refunds
All subscription purchases are handled by Apple. Refund requests must be submitted through Apple's support channels in accordance with their refund policies.
4.5 Price Changes
We reserve the right to change subscription prices. Any price changes will apply to subsequent billing periods, not your current subscription term. We will notify you of price changes in advance.
5. Feature Access & Restrictions
5.1 During Trial or Active Subscription
You have full access to all JABBA features, including:
- Unlimited transaction imports
- AI-powered repayment strategies
- AI-powered CSV field detection
- Multi-device synchronization
- All commitment tracking features
5.2 After Trial/Subscription Expiry
When your trial or subscription expires:
- Read Access Maintained: You can continue to view all your existing transactions, commitments, and balances
- Imports Disabled: You cannot import new bank statement CSV files
- AI Features Disabled: AI repayment strategies and CSV field detection are unavailable
- Data Preserved: Your data remains on your device and is never deleted due to subscription status
Your Data is Yours: We will never delete or restrict access to your existing financial data, regardless of your subscription status.
5.3 Restoring Purchases
If you have previously subscribed, you can restore your subscription on any device by using the "Restore Purchases" option in the App.
6. User Responsibilities
When using JABBA, you agree to:
6.1 Acceptable Use
- Use the App only for lawful, personal financial management purposes
- Provide accurate financial information
- Not attempt to reverse engineer, decompile, or disassemble the App
- Not use the App to store or transmit malicious code
- Not attempt to gain unauthorized access to our systems or other users' data
6.2 Data Accuracy
You are responsible for the accuracy of the financial data you enter into JABBA. We do not verify the correctness of your imported transactions or manually entered information.
6.3 Backup Responsibility
While JABBA stores data locally and offers optional cloud sync, you are encouraged to maintain your own backups of important financial records. We are not responsible for data loss due to device failure, accidental deletion, or other circumstances.
7. Intellectual Property
7.1 Our Rights
JABBA, including its design, features, code, graphics, and content, is owned by Helix Data Solutions Limited and is protected by copyright, trademark, and other intellectual property laws.
7.2 License Grant
We grant you a limited, non-exclusive, non-transferable, revocable license to use JABBA for personal, non-commercial purposes in accordance with these Terms.
7.3 Your Data
You retain all ownership rights to the financial data you input into JABBA. We do not claim any ownership of your personal financial information.
7.4 Feedback
If you provide feedback or suggestions about JABBA, you grant us the right to use this feedback without restriction or compensation to you.
8. Disclaimer of Warranties
8.1 As-Is Basis
JABBA is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
8.2 No Financial Advice
Important Disclaimer: JABBA is a budgeting tool, not a financial advisor. The App, including AI-generated recommendations, does not provide professional financial, investment, tax, or legal advice. AI suggestions are based on the data you provide and general financial principles.
Always consult qualified professionals for important financial decisions. We are not responsible for any financial decisions you make based on information from JABBA.
8.3 Accuracy
While we strive for accuracy, we do not guarantee that:
- Calculations will be error-free
- AI recommendations will be optimal for your situation
- CSV import will correctly parse all bank statement formats
- The App will be uninterrupted or available at all times
8.4 Third-Party Services
We are not responsible for the availability, accuracy, or practices of third-party services (Apple, Cloudflare, etc.) that JABBA relies upon.
9. Limitation of Liability
9.1 Exclusion of Damages
To the maximum extent permitted by law, Helix Data Solutions Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of profits, data, or business opportunities
- Financial losses resulting from reliance on App information or AI recommendations
- Damages arising from unauthorized access to your account
- Service interruptions or data loss
9.2 Maximum Liability
Our total liability for any claims arising from your use of JABBA shall not exceed the amount you paid us in subscription fees during the 12 months prior to the claim, or $50 USD, whichever is greater.
9.3 Essential Purpose
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
10. Termination
10.1 Termination by You
You may stop using JABBA at any time. To fully terminate your account:
- Cancel any active subscription through the App Store
- Delete your account through the App's settings
- Uninstall the App from your devices
10.2 Termination by Us
We may suspend or terminate your access to JABBA if:
- You violate these Terms
- You engage in fraudulent or illegal activity
- Required by law
- We discontinue the Service (with reasonable notice)
10.3 Effect of Termination
Upon termination:
- Your right to use the App ceases
- Data stored locally on your device remains accessible until you delete the App
- Cloud-synced data is retained for 6 months per our data retention policy
- Provisions that should survive termination (liability, intellectual property, dispute resolution) remain in effect
11. Governing Law
These Terms are governed by and construed in accordance with the laws of New Zealand, without regard to its conflict of law principles.
Any legal action or proceeding arising from these Terms shall be brought exclusively in the courts of New Zealand, and you consent to the personal jurisdiction of such courts.
12. Dispute Resolution
12.1 Informal Resolution
Before initiating any formal legal proceedings, you agree to first contact us at jabba@oneway.co.nz to attempt to resolve any dispute informally. We will make good faith efforts to resolve disputes within 30 days.
12.2 Formal Proceedings
If informal resolution is unsuccessful, either party may pursue formal legal action in accordance with the Governing Law section above.
12.3 Class Action Waiver
To the extent permitted by law, you agree that any disputes will be resolved on an individual basis and not as part of any class, consolidated, or representative action.
13. Changes to Terms
We may update these Terms from time to time. When we make changes:
- We will update the "Last Updated" date at the top of these Terms
- For material changes, we will notify you through the App or via email
- Your continued use of JABBA after changes take effect constitutes acceptance of the new Terms
- If you do not agree to the revised Terms, you should stop using the App

15. Additional Terms
15.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Helix Data Solutions Limited regarding your use of JABBA.
15.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
15.3 Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
15.4 Assignment
You may not assign or transfer these Terms or your rights under them. We may assign our rights and obligations under these Terms in connection with a merger, acquisition, or sale of assets.
